PARKING FOR PERSONS WITH DISABILITIES
AMENDING CHAPTER¬¬ 34 TRAFFIC
An ordinance to amend the Township Code, Chapter 34.PITTSFIELD CHARTER TOWNSHIP, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS:That Article VI of Chapter 34, Sections 34-110 through 34-111, be added to the Pittsfield Township Code to read as follows:ARTICLE VI - PARKING FOR PERSONS WITH DISABILITIESSec. 34-110. Parking for persons with disabilities.1. No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic-control device, in:
a. A parking space reserved for a disabled person unless the individual is a disabled person as defined in MCL 257.19a or unless the individual is parking the vehicle for the benefit of a disabled person. In order for the vehicle to be parked in the parking space, the vehicle shall display 1 of the following:
i. A certificate of identification or windshield placard issued under MCL 257.675 to a disabled person.ii. A special registration plate issued under MCL 257.803d to a disabled person.iii. A similar certificate of identification or windshield placard issued by another state to a disabled person.iv. A similar special registration plate issued by another state to a disabled person.v. A special registration plate to which a tab for persons with disabilities is attached issued under MCL 257.803f.
b. In a clearly identified access aisle or access lane immediately adjacent to a space designated for parking by persons with disabilities.
c. On a street or other area open to the parking of vehicles that results in the vehicle interfering with the use of a curb-cut or ramp by persons with disabilities.
2. Absence of both the certificate of identification issued under MCL 257.675 and the special registration plate issued under MCL 257.803d shall be prima facie evidence of a violation of this section.3. A parking space reserved for disabled persons shall be clearly designated as such by a sign, the bottom of which shall be placed at least 60 inches above the surface of the parking space. The sign must be;a. Rectangular in shape and at least 12 inches wide and 18 inches high and marked in such a way as to clearly indicate the space is reserved for disabled persons, or;b. In conformity with the requirements of the Michigan Manual on Uniform Traffic Control Devices for signs designating parking for disabled persons.
Sec. 14-229. Adoption and effective date.This ordinance shall be published in the manner as required by law. Except as otherwise provided by law, these amendments shall be effective 30 days after first publication of the ordinance from which this chapter derives. This Ordinance was duly adopted by the Charter Township of Pittsfield Board at its regular meeting held on the 13th day of August 2014, and was ordered given publication in the manner required by law.
