[ARCHIVED] Public Notice - Wolverine Pipe Line Company Construction Permit

PUBLIC NOTICE
Wolverine Pipe Line Company, Attn: Steve Iseminger, 8075 Creekside Drive, Suite 210, Portage, Michigan 49024, has applied to this office for a permit under authority of Part 301, Inland Lakes and Streams, and Part 303, Wetlands Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA). The applicant proposes to construct approximately 33.8 miles of 16-inch diameter pipeline along a route that will primarily follow an existing pipeline. The newly placed pipe is proposed to be ten (10) feet away from existing pipe. The route will use existing easements between Wolverine's pipeline stations in Washtenaw County's Freedom Township and Wayne County's City of Romulus, Michigan. The existing, 50-foot ROW will be expanded to 75 feet in order to facilitate construction, installation, and operation of the new pipe line, including aerial reconnaissance. A total of 25 regulated waterbodies and 47 wetlands are proposed to be crossed by the pipeline. A total of approximately 24.73 acres of wetland will be impacted temporarily during excavation and storage of trench materials during construction. A total of 3.15 acres of forested wetland and a total of 4.48 acres of scrub shrub wetland are proposed to be converted to emergent wetland. Wetland restoration and mitigation are proposed. The project is located in Washtenaw County: Freedom Township; T03S, R04E, Sections 13, 14, 15; Lodi Township, T03S, R05E, Sections 15, 16, 17, 18, 21, 22, 23, 24; Pittsfield Township, T03S, R06E, Sections, 19, 20, 21, 22, 23, 25, 26; and Ypsilanti Township; T03S, R07E, Sections 25, 26, 27, 28, 29, 30, 3536; and in Wayne County: City of Romulus; T03S, R09E, Sections 20, 29, 30; and Van Buren Township; T03S, R08E, Sections 25, 26, 27, 28, 29, 30, 31, Michigan, in accordance with plans attached to this notice.
THIS NOTICE IS NOT A PERMIT
The proposed project may also be regulated by one or more additional parts of the NREPA that are administered by the Department of Environmental Quality (DEQ), Water Resources Division (WRD). The requirements of all applicable parts are considered in determining if a permit can be issued. When a permit application is received requesting authorization to work in or over the inland waters of the State of Michigan, pursuant to Part 301, Part 303, Part 31, of the NREPA, the NREPA provides that the DEQ submit copies for review to the department of public health; the city, village, or township and county where the project is to be located; the local soil conservation district; any local watershed council organized under Part 311, Local River Management, of the NREPA. Additional notification is provided to certain persons as required by statute or determined by the DEQ. Those persons wanting to make comments on the proposed project shall furnish this office with their written comments no later than 20 days from the date of this notice. Written comments will be made part of the record and should reference the above file number. Objections must be factual, specific, and fully describe the reasons upon which any objection is founded. Unless a written request is filed with the DEQ within the 20-day public comment period, the DEQ may make a decision on the application without a public hearing. The determination as to whether a permit will be issued or a public hearing held will be based on an evaluation of all relevant factors, including the public comments received and the effect of the proposed work on the public trust or interest, including navigation, fish, wildlife, and pollution. The specific permit decision criteria can be found in the Parts of NREPA applicable to this application and listed above. Copies of these Parts of NREPA are at www.michigan.gov/jointpermit. Public comments received will also be considered.

This application will be reviewed by federal agencies in accordance with an agreement with the United States Environmental Protection Agency
